AFSA appealed to entrepreneurs and consumers regarding food supplements

As it is known, in accordance with sub-item 3.0.33-20 of the “Regulations on the Food Safety Agency of the Republic of Azerbaijan” approved by the Decree of the President of the Republic of Azerbaijan dated November 13, 2017, import, export of food supplement  to control the production, sale and turnover has ascribed  to the position of the agency.According to Article 6 of the Law of the Republic of Azerbaijan “On food products”, food imported into the Republic of Azerbaijan must be accompanied by a duly recognized or food safety (health) certificate issued by the relevant executive authority.However, in some cases, it is being observed  that entrepreneurs violate the requirements of the law.

Thus, according to the legislation, the instructions for use of  food supplements should contain the phrase "can not be used for the treatment of diseases."Also,  food supplements may be prescribed by a doctor to strengthen the body, enrich the diet, but do not replace drugs prescribed for the prevention or treatment of these diseases.Due to these requirements, it is not allowed to indicate in the instructions for use of FS  the name of any disease, its use for the purpose of prevention and treatment, or expressions that give such an impression.

In this regard, despite repeated appeals to entrepreneurs, there are still attempts to give the impression that FS's can be used for the treatment or prevention of diseases, resulting in the formation of misconceptions about such products by consumers.

We reiterate that although FS' s are pharmaceutically prepared products in a certain daily dose, their only purpose is to enrich the diet.

The agency once again appeals to entrepreneurs operating in this field, stating that the processes of import and sale of  food supplements imported into the country must be provided in accordance with the requirements of existing legislation.The sale  and providing food safety certificate of e food supplements  imported in violation of the legislation will not be allowed.

One of the main activities of the Agency is to provide the population of the country with healthy food and the organization of control in this area, the circulation of products and services offered by businesses in this area only with the protection of consumer rights.
